The terms under which POW provides its printing services.

Introduction

These Terms and Conditions ("Terms") govern your use of the POW website and the services provided by POW ("we", "us", "our"). By accessing our website or engaging our services, you agree to be bound by these Terms.

If you do not agree with any part of these Terms, please do not use our website or services.

Definitions

"Client" refers to the individual or organisation engaging POW’s services.

"Services" refers to the direct-to-surface printing services provided by POW, including but not limited to wall printing, glass printing, floor graphics, and surface branding.

"Artwork" refers to any design, image, graphic, or content provided by the Client for printing.

"Surface" refers to the physical surface onto which POW prints.

"Quote" refers to the estimated cost and scope of work provided by POW for a specific project.

Services

POW provides direct-to-surface printing services on a variety of surfaces including walls, glass, wood, metal, doors, floors, ceilings, and other suitable flat surfaces.

We reserve the right to decline any project if, in our professional opinion, the surface is unsuitable for printing, the artwork is inappropriate, or the project cannot be completed to our quality standards.

POW does not print on water or surfaces that cannot accept direct printing. We will advise on alternative solutions where possible.

Quotes and Pricing

All quotes provided by POW are estimates based on the information provided by the Client at the time of enquiry. Final pricing may vary depending on site conditions, surface preparation requirements, and other factors identified during the project.

Quotes are valid for 30 days from the date of issue unless otherwise stated.

POW reserves the right to adjust pricing if the project scope changes after the initial quote is provided.

Artwork and Intellectual Property

The Client warrants that all Artwork provided to POW is either owned by the Client or the Client has obtained all necessary licences and permissions to use the Artwork for printing purposes.

The Client indemnifies POW against any claims of copyright infringement, trademark infringement, or other intellectual property violations arising from the Client’s Artwork.

POW reserves the right to refuse to print Artwork that is illegal, defamatory, offensive, or infringes on the rights of third parties.

POW retains ownership of all printing techniques, processes, and methods used in the delivery of services.

Surface Preparation and Warranties

The Client is responsible for ensuring the Surface is clean, dry, and suitable for printing before POW arrives on site. POW will advise on preparation requirements during the quoting process.

POW warrants that printed graphics will be free from defects in materials and workmanship for a period of 12 months from the date of completion, subject to proper care and maintenance.

This warranty does not cover damage caused by improper surface preparation, moisture ingress, physical impact, abrasive cleaning, exposure to harsh chemicals, or other factors beyond POW’s control.

POW’s liability under this warranty is limited to repair or reprint of the affected area at our discretion.

Payment Terms

A deposit of 50% of the quoted price is required to secure a project booking. The remaining balance is due upon completion of the work.

For projects exceeding £5,000, a staged payment schedule may be agreed in writing.

Payment is due within 14 days of invoice. Late payments may incur interest at 4% above the Bank of England base rate.

POW accepts payment by bank transfer, credit card, and debit card.

Cancellation and Rescheduling

If the Client wishes to cancel a project after a deposit has been paid, the deposit is non-refundable to cover scheduling and preparation costs.

If POW cancels a project, any deposit paid will be refunded in full.

Rescheduling requests must be made at least 48 hours before the scheduled date. Rescheduling within 48 hours may incur a fee.

Limitation of Liability

POW’s total liability arising from or in connection with the services shall not exceed the total amount paid by the Client for the specific project giving rise to the claim.

POW shall not be liable for indirect, consequential, or loss-of-profit damages.

POW is not liable for damage to surfaces that are structurally unsound, damp, or otherwise not fit for printing, provided we have acted in accordance with our professional assessment.

Confidentiality

Both parties agree to keep confidential any information disclosed by the other party that is designated as confidential or is reasonably understood to be confidential.

This obligation survives the termination of any project or service agreement.

Data Protection

Both parties agree to comply with all applicable data protection laws, including the GDPR and Data Protection Act 2018. Please refer to our Privacy Policy for details on how we handle personal data.

Force Majeure

Neither party shall be liable for failure to perform obligations under these Terms if the failure is caused by events beyond their reasonable control, including but not limited to natural disasters, extreme weather, pandemics, war, or government action.

Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms or our services shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Changes to These Terms

We may update these Terms from time to time. We will notify you of any significant changes by posting the new Terms on this page and updating the "last updated" date. Your continued use of our services after changes are posted constitutes acceptance of the updated Terms.
